1. Agreement
These Terms of Hire apply to all drone and drone-related equipment hired from us (“Drone Equipment”), including agricultural spray drones, batteries, controllers, accessories, trailers and supporting systems.
By booking, collecting, accepting delivery of, or using Drone Equipment, you agree to these Terms.
2. Hire Period
The hire period begins when:
- Drone Equipment is collected by you; or
- Delivered to your nominated location.
The hire period ends when Drone Equipment is returned to us or collected by us (“Actual Return Date”).
Hire charges continue until all Drone Equipment has been returned and inspected.
Minimum hire periods may apply.
3. Hire Charges
Hire charges are as quoted or invoiced.
Charges apply for the full hire period including weekends and public holidays unless otherwise agreed in writing.
Hire charges continue until Drone Equipment is returned, regardless of whether it is being used.
Deposits or reservation fees may apply.
4. Payment Terms
Invoices must be paid within the timeframe stated on the invoice.
We may charge:
- Interest on overdue accounts;
- Debt recovery or legal costs incurred recovering unpaid amounts.
We may suspend or refuse further hire where accounts are overdue.
5. Delivery and Collection
Delivery and collection times are estimates only.
Additional charges may apply for:
- Waiting time;
- Failed delivery or collection;
- Remote locations.
Drone Equipment must be accessible and ready at agreed collection times.
6. Ownership
All Drone Equipment remains our property at all times.
You must not:
- Sell;
- Lease;
- Sub-hire;
- Mortgage; or
- Grant security over Drone Equipment.
7. Risk and Responsibility
Risk transfers to you at the start of the hire period.
You are responsible for:
- Loss;
- Theft;
- Damage;
- Weather exposure;
- Transport damage; and
- Operator misuse.
Responsibility continues until Drone Equipment is returned and accepted by us.
8. Operator Requirements
Drone Equipment must only be operated by persons who:
- Hold required aviation licences or certifications where applicable;
- Are trained and competent;
- Comply with all aviation and workplace safety laws.
You are responsible for ensuring compliance with all applicable aviation authority regulations and operational approvals.
9. Safe Use
You must:
- Use Drone Equipment only for its intended agricultural or commercial purpose;
- Follow manufacturer instructions;
- Conduct risk assessments prior to operation;
- Maintain safe operating environments.
Drone Equipment must not be used:
- Outside Australia without written approval;
- In hazardous or illegal operations;
- By untrained operators.
No modifications or repairs may be undertaken without approval.
10. Insurance
You must maintain adequate insurance covering:
- Loss;
- Theft;
- Damage; and
- Third-party liability arising from drone operations.
Insurance must remain active for the full hire period.
11. Breakdown or Faults
If Drone Equipment becomes unsafe or stops working you must:
- Stop using it immediately;
- Notify us as soon as possible.
Do not attempt repairs without approval.
Where breakdown is not caused by misuse, we will repair or replace Drone Equipment within a reasonable timeframe.
Hire charges may continue where delays are caused by site access or operator factors.
12. Damage, Loss or Theft
You are responsible for repair or replacement costs where Drone Equipment is:
- Lost or stolen;
- Damaged beyond normal wear and tear;
- Crashed or misused;
- Operated negligently.
Hire charges may continue during repair or replacement periods.
13. Return of Drone Equipment
Drone Equipment must be returned:
- Clean;
- Fully operational;
- With batteries, accessories and components.
Cleaning, repair or replacement charges may apply.
Missing accessories or batteries will be charged at replacement value.
14. Additional Charges
Additional charges may include:
- Cleaning;
- Repairs;
- Consumables;
- Replacement parts;
- Delivery or travel;
- Training or operational support requested;
- Government fines or penalties arising from your operations.
15. Liability
To the maximum extent permitted by law:
- We are not liable for indirect or consequential loss including crop loss, business interruption or loss of income.
- Liability is limited to repair, replacement or resupply of Drone Equipment or services.
You indemnify us against claims arising from your operation or possession of Drone Equipment except where caused by our negligence.
Drone operations involve inherent risks and you accept those risks.
16. Termination
We may immediately terminate hire if:
- Payments are overdue;
- Terms are breached;
- Drone Equipment is used unsafely or unlawfully.
Outstanding amounts become immediately payable.
17. Recovery of Drone Equipment
If hire ends or terms are breached, we may enter premises where Drone Equipment is located to recover it.
You must assist with locating and returning Drone Equipment.
Recovery costs may be charged to you.
18. Equipment Condition
You must notify us within 24 hours of receiving Drone Equipment if it is damaged or defective.
Otherwise Drone Equipment is taken to be accepted in good working condition.
19. Privacy
We may collect and use business or personal information to:
- Provide hire services;
- Verify identity or creditworthiness;
- Prevent theft or fraud.
20. Force Majeure
Neither party is responsible for delays caused by events outside reasonable control including weather, transport disruption or natural disasters.
Payment obligations and responsibility for Drone Equipment continue during these events.
21. Governing Law
These Terms are governed by the laws of Queensland, Australia.
